When can you request changes to your custody agreement?

One of the repercussions of divorce is the challenge of co-parenting with someone you are no longer married to. For some couples, this happens easily. For most, however, sharing custody has its fair share of complications.

There may be several reasons why you want to change your custody order. Knowing under which conditions you can request a modification may help you strategize your next steps.

Relocation

One of the more common reasons to request a modification is relocation. You might wish to accept a job that requires you to move. Perhaps you want to further your education and the institution of your choice is further away. In some circumstances, you might even want to move so you can have the support of family members while you manage single parenting.

Non-compliance

Another reason to ask for changes to your custody order is if your ex refuses to comply with its terms and conditions. According to CNN, many divorced couples struggle to look past differences and put their children first. If this is the case for your ex and continued disregard for shared responsibilities begins to jeopardize your commitments, you might need to make changes.

Danger

An absolutely valid reason to petition the courts for a modification to your custody order is if you suspect your ex puts your children in danger. This could include suspicions of abuse, neglect and abandonment. Your children deserve a safe and functional home environment and you are an advocate for their protection.

Asking for changes to your custody order is a process that requires time and patience. With the right approach, you may improve your chances of an outcome that aligns with what you hoped for.
